I am a project administrator for a company. I just found out that the space we were working in has tested positive for Asbestos and Lead (came back 16 times the legal limit). I have the papers with the Asbestos test results that are positive. I am trying to figure out if I should contact a lawyer, do I have a case, what information should I gather for my case (if I have one). If you can shed some light on this situation I’d greatly appreciate it because the bottom line of my situation is YES I have been exposed to Asbestos (and I have the test results) and YES I have been exposed to Lead. Simply being exposed to lead or asbestos is not grounds for a lawsuit. You have to have incurred some sort of medical condition due to the exposure. You haven’t, so you can’t sue.
I hate people like you, always looking for an excuse to sue people, thinking your gonna get rich.

I think you have a pretty good case here. These tests should have been completed before you were sent to work in that space in my opinion. This way you would be aware and wear the proper masks/suits while working/visiting the space. I would think all you need to prove would be that you had no knowledge of the asbestos and lead going into the space.
Then you could also have the problem that the person in charge of the space might have not known either but it should be their responsibility to take samples to the proper labs just to make sure.

How long were you there? The thing is that lead poisoning and asbestosis take a LONG time to mature. If you were there for a short amount of time, you don’t have a case. You should FIRST go see a doctor, and only then if you have any problems, then see a lawyer.
Absent any problems, you have NO case. The mere worry about developing disease or problems is not grounds for recovery. Based on the information that I have heard, I would not take your case.

Typically, you can’t sue until you have actually been harmed, which wouldn’t happen until you got sick, if ever.

Why would you need to contact a lawyer just because you’ve been exposed to asbestos? In my school, most of the floor tiles and ceiling tiles contain asbestos (there are signs warning us) the school has been open 50 years now and nobody there has died from exposure from asbestos.
Sure asbestos isn’t great for you and neither is lead, but it’s not like you’re touching it day in day out, you’re just near it.
I don’t believe you have a case, or if you’re in America (please don’t take this the wrong way) but you probably will have a case because of the culture of always needing someone to blame. At the time when the asbestos was put in place, it wasn’t seen as dangerous, you can’t blame someone for ignorance about a chemical.
I’ve been exposed to asbestos, I’m a chemist so I’ve been exposed to lead, I’m not suing anyone, lots of the buildings you go into daily (not just the one you work in) will probably test positive for asbestos, are you going to sue the people who own those buildings too?
I don’t think you have a case personally, but I’m sure somebody does.
Edit: Nobody is saying that you don’t have a right to be worried, we’re saying you don’t have a legal case. People have worked around Asbestos a lot longer than you probably have been and nothing bad has come from it, yes it can happen but at the moment there is nothing wrong with you.
You can’t file a court case until there is something wrong with you.
There are people still working with asbestos day in day out, just be careful. If you don’t like it you have two choices a) change jobs or b) ask your employer to talk to the owner of the building about removing the asbestos and lead.

Don’t worry about who to sue and what you get etc.. That comes later.
You are exposed to dangerous levels of both which can put you out of commission. First, get that taken care of by a professional. Asbestosis (a form of cancer of duodenum) has been proven in people exposed to it.
Lead – leads to poisoning – that affects your nervous system.
You don’t want to be a cancer patient with nervous system disorder, do you.? So this is priority #1 to get looked after.
Second, keep all your medical records from day 1 and go after whoever is responsible. Erin Brokovich is currently handling just such cases. I do not know how to contact her, but you can type in yellow pages or on your google and go from there.
